Terms of Service

1.Eligibility

The Service is intended for users aged 13 and over. You must be at least 13 years old, or older if the law of your country sets a higher minimum age for using online services, to use the Service.

If you are under the age of majority in your country, you may use the Service only with the involvement and consent of a parent or legal guardian, who is responsible for any purchases made through your device.

The Service is not directed to children under 13, and we do not knowingly permit their use of the Service.

2.Description of the Service

WiziWords is an English language learning application that provides educational content, including vocabulary, translations, example sentences, quizzes, progress tracking, and premium learning features.

We may modify, improve, suspend, or discontinue any part of the Service at any time without prior notice.

3.No Account Required

WiziWords does not require you to create an account, register, or sign in. You can use the Service without providing us with a username, password, email address, or any other login credentials.

Your learning progress is stored locally on your device. If you uninstall the application, clear its data, or switch devices, that progress may be lost.

If you purchase a subscription, your access to premium features is linked to the Google Play account used to make the purchase — not to any account with us. You can recover access on a new installation or device by signing in to that same Google Play account and using the “Restore Purchases” option in the application.

4.Subscription and Premium Features

Certain features of WiziWords require a paid subscription (“WiziWords Premium”). Subscriptions are offered on a monthly or yearly basis.

Billing. Subscriptions are sold and billed through Google Play. Payment is charged to your Google Play account at confirmation of purchase. Prices are shown in your local currency within the application before you complete a purchase and may vary by country. We do not receive or store your payment card details.

Automatic renewal. Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your Google Play account will be charged the then-current price for the renewal term.

Cancellation. You may cancel at any time through the subscription settings of your Google Play account. Cancellation takes effect at the end of the current billing period; you retain access to premium features until then. Uninstalling the application does not cancel a subscription.

Changing plans. If you switch between the monthly and yearly plans, the change is applied immediately and any unused portion of your current plan is credited as additional time on your new plan, in accordance with Google Play’s billing rules.

Price changes. We may change subscription prices. Where required, you will be notified in advance and given the opportunity to cancel before the new price takes effect.

Refunds. Purchases are processed by Google Play, and refund requests are handled under Google Play’s refund policy. We are not able to process refunds directly.

Consumers in the European Union and United Kingdom. You may have a statutory right to withdraw from a purchase within 14 days. Because the Service provides immediate access to digital content, by completing a purchase you request immediate performance and acknowledge that this right may be lost once access begins, to the extent permitted by applicable law.

5.License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service solely for your personal, non-commercial use.

You may not:

• copy or redistribute the application;
• modify or create derivative works;
• reverse engineer, decompile, or disassemble the application except where permitted by law;
• use automated tools to scrape or extract content;
• attempt to bypass security mechanisms or technical protections.

6.Intellectual Property

The Service, including its software, design, logos, databases, educational content, vocabulary collections, translations, example sentences, graphics, audio, and other materials, is owned by WiziWords or its licensors and is protected by applicable intellectual property laws.

Nothing in these Terms transfers ownership of any intellectual property rights to you.

7.Acceptable Use

You agree not to:

• violate any applicable law;
• interfere with the operation of the Service;
• upload malicious software;
• abuse or exploit bugs or vulnerabilities;
• impersonate another person;
• use the Service for fraudulent or unlawful purposes;
• attempt unauthorized access to our systems.

8.Educational Content

The educational content provided by WiziWords is intended for general language learning purposes.

Although we strive for accuracy, we do not guarantee that vocabulary, translations, pronunciations, grammar explanations, or example sentences are complete, accurate, or free from errors.

You are responsible for verifying information when accuracy is important.

The Service is a general-purpose study aid and is not professional translation, linguistic, academic, or legal advice. You should not rely on it for examinations, official documents, or any purpose where an error could cause harm.

We do not promise any particular learning outcome. A subscription provides access to the Service, not a result.

9.Third-Party Services

The Service relies on a limited number of third-party providers:

• Google Play — for application distribution, billing, and subscription management;
• RevenueCat — for validating purchases and determining subscription status;
• your device’s built-in speech engine — for pronunciation playback, which is generated on your device.

Your use of Google Play is also governed by Google’s own terms and privacy policy. We are not responsible for third-party services.

10.Privacy

Our collection and use of personal information is described in our Privacy Policy.

By using the Service, you acknowledge that your information may be processed in accordance with that policy.

11.Termination

We may suspend or terminate your access to the Service if:

• you violate these Terms;
• your use presents a security risk;
• required by law;
• necessary to protect other users or the integrity of the Service.

You may stop using the Service at any time by uninstalling the application and cancelling any active subscription through your app store account.

12.Availability

We strive to keep the Service available but do not guarantee uninterrupted or error-free operation.

The Service may occasionally become unavailable due to maintenance, technical issues, software updates, network failures, or circumstances beyond our reasonable control.

13.Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WIZIWORDS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

14.Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WIZIWORDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, LOSS OF BUSINESS OPPORTUNITIES, OR BUSINESS INTERRUPTION ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR USD $50 IF NO PAYMENT WAS MADE, WHICHEVER IS GREATER.

15.Indemnification

You agree to indemnify and hold harmless WiziWords, its owners, employees, contractors, and affiliates from any claims, liabilities, damages, losses, and expenses arising from your misuse of the Service or your violation of these Terms.

16.Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we will update the Effective Date and may provide additional notice where required by law.

Your continued use of the Service after the updated Terms become effective constitutes your acceptance of the revised Terms.

17.Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of law principles. The competent courts of Tel Aviv–Jaffa, Israel shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms.

Nothing in this section deprives you of the protection of any mandatory consumer-protection laws of the country in which you reside.
